My claim was denied because the hose bib is outside. If you read the contract it states it must be on the inside of the foundation unless otherwise specified. In the plumbing section it list "hose bibs" as covered which makes it "otherwise specified".
Florida Statute 634.312 (4) states items that are exempt from a home warranty MUST be in bold font. If your items are not in bold font then it is covered per Florida Statutes. If they still deny you the repair then you need to contact three entities in Florida 1. Attorney General's Office 2. Florida's Chief Financial Officer 3. Florida Department of Agriculture and Consumer Services (FDACS)
Every contract they current have with a Florida Resident is illegal. Along with putting exempt items in bold font they are also required to have this language in the document “Certain items and events are not covered by this contract. Please refer to the exclusions listed on page of this document.”
Do not give up and continue the fight against this awful company. If you read all the bad reviews on this company they perform an awful service and will never pay for anything without a fight.
Also if they ever tell you that you can not sue them because an arbitration clause in their contract that is wrong as well. The superior court of New Jersey ruled that arbitration clauses must be in their own section of the contract and must stand out. They have these clause hidden in the miss. section.
Remember you are not alone they have screwed over a lot of people keep on fighting and bring it to the attention of your public officials so they can help you fight them.
