Below is my appeal to AHS which explains it all.***********
Please consider this as our formal request to receive the AHS "cash out option" and to be fully reimbursed for two air conditioning units, air handlers and associated equipment pursuant to the terms of the referenced contract. Replacement units were installed by XXX Air Conditioning and Heating who is not a AHS contractor.
Attached is invoice from XXX Air Conditioning & Heating in the amount of $??,000 relating to the replacement of a 4 & 5 ton (11 yrs old) American Standard AC systems, Air Handlers, Condensers, Plenums, Drain Pans, Float Switches, Heat Strips and Thermostats.
At the time our two units failed to cool, we contacted AHS Service Center and were directed to use YYY A/C. On the first of two subsequent visits, the YYY technician informed us that the Freon level on one unit was full and the other unit was only "slightly" low. He installed new capacitors and told us the "board" needed to reset. Neither unit cooled after this service visit. The second service visit occurred ~4 days later. The serviceman advised us that the 4 ton unit had zero Freon level, and the other 5 ton unit was very low. He recommended replacing both air handlers and outside units, however, AHS unilaterally decided that only the air handlers would be replaced.
This is to formally appeal the decision not to replace the outside units as well as the inside air handlers and to ask for the cash out option to cover the costs incurred to replace this equipment properly. Both outside units are R22, two speed - dual compressors, and you must replace both the inside and outside units in order to match the two and maintain their energy efficiency ratings. If not matched, we would loose the two speed capability of the outside units, and would NOT be capable of replicating the efficiency of the units. AHS is obligated to replace non-functioning equipment with equipment of the same or comparable ratings and performance. Due to: (i) the inferior service provided by the first YYY A/C service call, and (ii) the repeated delays and slow response received by AHS and YYY, we had no choice but to buy and replace the equipment from another A/C contractor. Summers in the South are very hot, and we need air conditioning installed and running for our own health and to prevent mold from accumulating in a hot, humid environment.
